Privacy Policy — Smart Scale AI Marketing
1. Who we are
Smart Scale AI Marketing ("we," "us," "our") provides buyer-intent lead generation services for local service businesses, including free buyer-intent snapshots, guided lead pilots, and done-with-you / done-for-you marketing programs.

2. Information we collect
Information you give us directly. When you request a free buyer-intent snapshot or contact us through our website, we collect:
- First and last name
- Email address
- Phone number
- Business name
- City
- Your #1 core service
Information collected automatically. Our website does not currently use third-party analytics, advertising pixels, or tracking cookies. Standard server logs (IP address, browser type, pages visited) may be recorded by our hosting provider for security and performance purposes.
Information from lead generation services. As part of our service to clients, we capture publicly available buyer-intent signals and enrich lead data from lawful third-party sources. If you are a consumer whose information appears in a client campaign, see Section 8.
3. How we use your information
We use the information we collect to:
- Deliver your requested buyer-intent snapshot and respond to inquiries
- Provide, operate, and improve our lead generation services
- Send service-related communications (delivery confirmations, follow-ups you requested)
- Send marketing communications only where you have opted in or where permitted by law — you may opt out at any time
- Comply with legal obligations and protect against fraud or misuse
We do not sell your personal information.
4. How we share your information
We share information only as follows:
- Service providers: Our customer relationship system (HighLevel) stores form submissions so we can fulfill snapshot requests. Providers process data only on our instructions and under confidentiality obligations.
- Legal compliance: When required by law, court order, or to protect our rights and safety.
- Business transfer: In connection with a merger, acquisition, or sale of business assets, with notice to you.
We do not share, rent, or sell your information to third parties for their own marketing.
5. Data retention
We retain contact and snapshot-request records for 24 months from your last interaction, or longer where required by law.
6. Your privacy rights (California — CCPA/CPRA)
If you are a California resident, you have the right to:
- Know what personal information we collect, use, and disclose
- Delete your personal information (with legal exceptions)
- Correct inaccurate personal information
- Opt out of the sale or sharing of personal information (we do not sell information)
- Non-discrimination for exercising these rights
To exercise any of these rights, email hello@jhoannarius.com with the subject line "Privacy Request." We will verify your identity and respond within 45 days as required by law.
7. Security
We use reasonable administrative, technical, and physical safeguards to protect your information, including encrypted transmission (HTTPS) and access controls on our CRM. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. A note for consumers in client campaigns
Our clients use our services to reach people actively searching for their services. If you received outreach as part of a client campaign and want to opt out of future messages from that business, reply STOP (SMS) or use the unsubscribe link (email). To ask what information we hold about you in connection with lead services, contact us at the address above.
9. Children's privacy
Our services are directed to business owners and are not intended for children under 13. We do not knowingly collect information from children under 13.
10. Changes to this policy
We may update this policy from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of our website or services after changes take effect constitutes acceptance.

Terms of Service — Smart Scale AI Marketing
1. Agreement and parties
These Terms of Service ("Terms") form a binding agreement between you ("Client," "you") and Rius Ventures LLC ("Smart Scale AI Marketing," "we," "us"), a California limited liability company. By using our website, requesting a free buyer-intent snapshot, or purchasing any service, you agree to these Terms.
2. Our services
Smart Scale AI Marketing provides buyer-intent lead generation for local service businesses:
- Free buyer-intent snapshot — a 7-day sample of qualified buyer searches in your market, delivered as described on our website
- Lead Signal guided pilot — a 14-day guided pilot; setup and support are free, and you pay only for leads used at the per-lead rate shown on our website at the time of purchase
- Monthly lead top-up — recurring lead credits at the then-current per-lead rate
- Smart Scale Lab — done-with-you AI marketing software and systems, at the price shown on our website at the time of purchase
- Full Suite — done-for-you marketing services, at the price shown on our website at the time of purchase, subject to a qualification call
Service descriptions and prices on our website are illustrative and may change. The price that applies to you is the one shown at the time you purchase or as stated in your written agreement; price changes do not affect services already purchased.
3. Snapshot requests
Snapshot requests submitted through our website are stored in our CRM and fulfilled manually, typically within 24 hours. The snapshot reflects a 7-day sample window and reports qualified buyer counts only; we do not report total searches or filtering breakdowns. Sample lead examples are drawn from real campaign data and anonymized.
4. Payment
- Pilot lead charges and top-ups are billed at the per-lead rate shown on our website at the time of purchase, as incurred or as agreed in writing.
- Smart Scale Lab and Full Suite are billed at the price shown on our website (or stated in your written agreement) before work begins.
- You authorize us (or our payment processor) to charge your chosen payment method. You are responsible for keeping payment information current.
5. Refunds and cancellations
Before we start. Full refund, no questions asked, any time before the first of these: your kickoff call, your Smart Scale Lab license being set up, or your first lead being delivered. This applies for up to 7 days from payment, and it applies to deposits.
After we start. The one-time fee covers setup work and your 12-month license, both delivered at the start, and is not refundable once work has begun. Leads already delivered are not refundable.
Stopping your monthly leads. Cancel your lead top-up any time with 30 days' notice. No penalty, no exit fee.
Your license. On Full Marketing Suite and Smart Scale Lab, your Smart Scale Lab license is yours for the full 12 months from the day it is set up, even if you stop buying leads. If you paid by deposit and the balance is unpaid, the license ends. Lead Signal does not include a license: it is lead delivery for 3 months.
Bonus leads. Bonus leads are promotional. They have no cash value and cannot be transferred. If you cancel before they have all been delivered, any you have not received are void from the date you cancel. Unused bonus leads also expire at the end of your term.
Renewals. We tell you at least 14 days before any renewal charge, and you can cancel in one click.
6. Our 95% promise
We guarantee 95% of the leads we deliver carry a valid email address. If we fall short, we deliver replacement leads until we have made it up. On Full Marketing Suite, where we run your campaigns, you also get our appointments guarantee, set out in your agreement.
Our guarantee is not a refund. If we miss the targets in your agreement, we keep running your campaigns at no management fee for up to 90 days and extend your license by the same time. We do not return the fee.
7. What we don't promise
- We do not guarantee a specific number of leads, clients, appointments, or revenue. Buyer-intent volume varies by market, service, and season.
- Lead data is enriched from third-party sources; while we filter bots and verify emails, we do not warrant that every data point is complete or current.
- Marketing involves platforms we don't control (email providers, Meta, carriers). We are not liable for platform outages, policy changes, or deliverability shifts outside our systems.
8. Your responsibilities
You agree to:
- Provide accurate business information and promptly update us on changes
- Use leads and outreach in compliance with applicable laws (including CAN-SPAM, TCPA, and state telemarketing rules) — you are responsible for the content and targeting of messages sent under your direction once leads are delivered to you
- Not resell, redistribute, or publish lead data except in the normal course of your own marketing
- Maintain any licenses or consents required for your business's advertising
9. Cold outreach compliance
Where we send outreach on your behalf as part of done-for-you services, we follow CAN-SPAM requirements (accurate sender identification, truthful subject lines, a working opt-out mechanism honored within 10 business days, and a valid physical address). You remain responsible for the truthfulness of the offer content you approve.
10. Intellectual property
All website content, campaign frameworks, templates, and the Smart Scale Lab software and systems remain our exclusive property. Purchasing a service grants you a non-exclusive, non-transferable license to use deliverables for your own business marketing. You may not resell, sublicense, or reverse-engineer our systems.
11. Confidentiality
Each party agrees to keep the other's non-public business information confidential and use it only to perform under these Terms.
12. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the amounts you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or lost-profit damages.
13. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of leads or deliverables, your violation of law, or content you provided or approved.
14. Term and termination
- Pilot and top-up arrangements may be cancelled by either party with written notice; you remain responsible for leads already delivered.
- We may suspend or terminate services for non-payment, violation of these Terms, or unlawful use, with notice where practicable.
- Sections 8–13 survive termination.
15. Disputes and governing law
These Terms are governed by the laws of the State of California, and disputes will be resolved in the state or federal courts located in Monterey County, California.
16. Changes to these Terms
We may update these Terms with notice posted on our website. Material changes to pricing or refunds will be communicated directly to active clients. Continued use after changes take effect constitutes acceptance.
